Welcome to Softcrust Digital Experts. By accessing or using our website at softcrust.net or engaging our digital marketing services, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

Services

Softcrust Digital Experts provides the following digital marketing services:

Client Responsibilities

By engaging our services, you agree to:

Provide accurate, complete, and timely information required to deliver services

Grant necessary access to accounts (Google Ads, Meta Business, website, etc.) as reasonably required

Review and approve deliverables within agreed timelines

Ensure all materials provided to us are lawful and do not infringe third-party rights

Designate a primary point of contact for communication and approvals

Payment Terms

Pricing

Our services start from $199 per month. Exact pricing is specified in your accepted proposal or service agreement.

Billing

Services are billed monthly in advance unless otherwise agreed in writing. Payment is due within 7 days of invoice issuance.

Late Payments

Invoices unpaid after 14 days may result in a temporary suspension of services. Softcrust reserves the right to charge a 2% monthly late fee on overdue balances.

No Lock-In

We operate on a month-to-month basis. There are no long-term contracts unless expressly agreed in writing. You may cancel at any time with 30 days’ written notice.

Account Ownership

All advertising accounts, analytics profiles, and digital assets created or managed on your behalf remain the property of the client. You retain 100% ownership of all accounts — including Google Ads, Meta Business Manager, Google Analytics, and Search Console — at all times, including upon termination of services.

Results & Performance Disclaimers

Digital marketing results vary depending on industry competitiveness, budget, market conditions, and other factors outside our control. While we share case studies and historical performance data for illustration, Softcrust does not guarantee specific outcomes including but not limited to:

A specific number of leads, clicks, or enquiries

A specific return on ad spend (ROAS) or ROI

First-page Google rankings within a specific timeframe

We commit to applying best practices, industry expertise, and ongoing optimization to maximize your results.

Intellectual Property

i.Client Materials

You grant Softcrust a limited license to use your brand assets, logos, and content solely for the purpose of delivering agreed services.

ii.Deliverables

Upon full payment of all outstanding invoices, you own all final deliverables created exclusively for your account (ad creatives, landing pages, reports, etc.).

iii.Softcrust Tools & Processes

Our proprietary methodologies, templates, software tools, and internal processes remain the exclusive intellectual property of Softcrust Digital Experts.

iv.Portfolio Rights

Unless you request otherwise in writing, Softcrust reserves the right to reference your business name and general results (e.g., ‘X% traffic increase’) in our portfolio, proposals, and marketing materials.

Confidentiality

Both parties agree to keep confidential any proprietary information, trade secrets, business strategies, or sensitive data shared during the engagement. This obligation survives the termination of services for a period of two (2) years.

Limitation of Liability

To the maximum extent permitted by applicable law:

Softcrust’s total liability to you shall not exceed the total fees paid in the 3 months preceding the claim

We are not liable for indirect, consequential, incidental, or punitive damages

We are not responsible for platform policy changes (Google, Meta, etc.) that affect campaign performance

We are not liable for losses resulting from third-party service outages or algorithm updates

Termination

Either party may terminate the engagement with 30 days’ written notice. Upon termination:

All outstanding invoices become immediately due and payable

We will provide handover documentation and return access to all client-owned accounts within 7 business days

Softcrust may terminate immediately and without notice if the client engages in unlawful activity, payment fraud, or material breach of these terms

Governing Law & Dispute Resolution

These Terms are governed by the laws of Pakistan. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes may be submitted to binding arbitration or the competent courts of Islamabad, Pakistan.

For clients based in the United Kingdom or European Union, consumer protection laws of your local jurisdiction may apply in addition to these terms.

Modifications to Terms

Softcrust reserves the right to update these Terms at any time. Material changes will be communicated via email or website notice at least 14 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms.

Entire Agreement

These Terms, together with any signed proposal, service agreement, or scope of work document, constitute the entire agreement between you and Softcrust Digital Experts and supersede all prior communications or understandings.
